1. Acceptance of Terms

The following Terms & Conditions (the "Agreement") govern your use of the David's Trip Planner service (the "Service"), including the web application and all related features, whether free or paid, as provided by David Veit ("we", "us", or "the Operator").

By accessing or using the Service, you agree to be bound by this Agreement. If you do not agree to these terms, please do not use the Service.

We reserve the right to modify this Agreement at any time. Changes will be indicated by updating the "Last updated" date at the top of this page. Your continued use of the Service after any such changes constitutes your acceptance of the revised terms. It is your responsibility to review this Agreement periodically.

2. Accounts

• Registration: To use the Service, you must sign in with a Google account or register using an email address and password.
• Account Security: You are solely responsible for maintaining the security of your account credentials and any devices used to access the Service. You must notify us immediately if you suspect unauthorized access to your account.
• One Account Per Person: Each user may only maintain one account. You may not create accounts on behalf of others or misrepresent your identity.

3. Use of the Service

Personal and Lawful Use Only

The Service is provided for your personal, non-commercial use only. You agree to use the Service only for lawful purposes and in accordance with this Agreement.

Minimum Age

The Service is not intended for users under the age of 16. We do not knowingly collect personal data from individuals under 16. If you are under 16, please do not use the Service.

Prohibited Conduct

You agree not to:

• Access the Service through any automated means (e.g., scripts, bots, scrapers) not provided or authorized by us.
• Reproduce, duplicate, copy, sell, trade, or resell any portion of the Service.
• Use the Service to upload, post, or transmit any content that is harmful, threatening, unlawful, defamatory, abusive, obscene, or otherwise objectionable.
• Attempt to interfere with, compromise, or disrupt the Service or its underlying infrastructure.
• Use the Service to send unsolicited communications, spam, or promotional material.

4. User Content

• Ownership: You retain full ownership of all content you create within the Service, including trip names, activity details, notes, tags, and any other data you enter ("User Content").
• License to Operate: By using the Service, you grant us a limited, non-exclusive license to store, process, and display your User Content solely for the purpose of operating and providing the Service to you and your collaborators.
• User Responsibility: You are solely responsible for the accuracy, legality, and appropriateness of all User Content. You must not upload content that infringes on the rights of any third party.
• Data Deletion: You may delete your User Content and account at any time using the "Delete All My Data" feature on the dashboard. This permanently removes your account and all associated data.

5. Intellectual Property

The Service, including its design, code, branding, logos, and all related materials, is the intellectual property of the Operator and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, modify, or create derivative works based on the Service without prior written consent.

This Agreement does not grant you any rights to use the Operator's trademarks, service marks, or logos.

6. Third-Party Services

The Service integrates with the following third-party services to deliver its functionality:

We are not responsible for the availability, accuracy, or policies of any third-party services. Your use of third-party services is subject to their respective terms and privacy policies.

7. Liability Disclaimer

• We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
• We do not warrant the accuracy or completeness of any trip data, itinerary information, or location data provided through the Service.
• You acknowledge that you use the Service at your own risk.
• To the maximum extent permitted by applicable law, the Operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service.

8. Service Modification & Termination

• We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice.
• We may terminate or suspend your access to the Service at any time, for any reason, including but not limited to a breach of this Agreement.
• Upon termination, your right to use the Service ceases immediately. You may request deletion of your data at any time prior to termination.

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Republic of Austria, without regard to its conflict-of-law provisions. Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the competent courts in Austria.

If you are a consumer residing in the European Union, you retain any mandatory consumer protection rights granted to you under the laws of your country of residence, including access to your local courts.

10. General Provisions

• Severability: If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
• Entire Agreement: This Agreement, together with the Privacy Policy, constitutes the entire agreement between you and the Operator regarding your use of the Service.
• Assignment: We may assign our rights and obligations under this Agreement at our sole discretion. You may not assign your rights or obligations without our prior written consent.
• Language: This Agreement is written in the English language. In the event of any conflict between a translated version and the English version, the English version shall prevail.
